ADMINISTRATION ORDINANCE OF THE SCHAGHTICOKE INDIAN TRIBE
The Tribal Council shall select from within its members(i) a Chairperson,(ii) Vice Chairperson, (iii) a Secretary, (iv) a Treasurer, (v) Authorized Signature and other officers as the Tribal Council may deem necessary in accordance with ARTICLE V SEC. 2 of the Constitution.
The Tribal Chairperson shall have the duties and responsibilities associated with the office, subject to any provisions contained in the Constitution. The Tribal Chairperson shall in fact preside at all meetings of the Tribal Council and general membership of the Schaghticoke Indian Tribe and provide or cause to be provided to the Schaghticoke Secretary an agenda for these meetings. The Chairperson shall bring or cause to bring harmony among the individual members, families and clans of the Tribe. The Chairperson, together with the Treasurer shall execute all contracts, documents, leases, releases, deeds, mortgages (both real and personal property) and all other instruments on behalf of the Schaghticoke Indian Tribe or in the Name of the Schaghticoke Indian Tribe as authorized by the Tribal Council. The Chairperson shall have whatever duties and responsibilities, which the Tribal Council may, from time to time determine in the interest of the Schaghticoke Indian Tribe. The Chairperson or his/her designee shall be the spokesperson for the Schaghticoke Indian Tribe.
II. Vice Chairperson
The Vice Chairperson shall assume all the duties and responsibilities of the Chairperson in his/her absence, unavailability or when so authorized by the Tribal Council or Chairperson of the Schaghticoke Indian Tribe. The Vice Chairperson shall also perform such additional duties and responsibilities as the Chairperson and Tribal Council may deem appropriate.
The Secretary of the Schaghticoke Indian Tribe shall be the clerk of records. The Secretary shall keep and maintain or cause to be kept and maintained all record of the Schaghticoke Indian Tribe, which shall include but not be limited to the following:
a. Original and/or conformed copies of the Constitution of the Schaghticoke Indian Tribe.
b. Original or conformed copies of all ordinances and resolutions passed by the Tribal Council.
c. Names and addresses of all facilties, family genealogies and histories of all voting and non-voting members, certified or not certified of the Tribe.
d. Names, addresses, telephone numbers and email addresses of all Tribal Council members.
e. All other records and/or documents retained by the Schaghticoke Tribal Council and so ordered by the Tribal Council. The Secretary shall keep or cause to be kept, all minutes of the Tribal Council meeting and meetings of the general membership, including a minute book wherein will be kept a record of tribal resolutions. The Secretary shall also send out or cause to be sent out all newsletters, notices of regular, special and annual meetings of the Tribal Council and general membership.
f. The Secretary shall originate and maintain all materials for tribal elections, including notices of elections, nominating petitions, voting ballots and petitions for special elections in accordance with ARTICLE VIII Sec. 10 of the Constitution. The Secretary shall record and maintain all records of results and certifications of elections, Council, clan, special and general.
g. The Secretary shall also keep or cause to be kept photographs or pictorials of members of the Schaghticoke Indian Tribe. The Secretary with general counsel shall keep or cause to be kept all documents pertaining to the history and petition process of the Schaghticoke Indian Tribe.
The Treasurer shall maintain the financial records of the Schaghticoke Indian Tribe. The Treasuer shall have custody of all moneys, receipts, records, deeds, debts, obligations, contracts, documents and other financial reports of the Schaghticoke Indian Tribe. The Treasurer with the Chairperson shall be empowered to make, sign,endorse and accept for the Schaghticoke Indian Tribe all promissory notes, bills of exchange, drafts, checks, bills and vouchers. The Treasurer may pay out funds as authorized by the Tribal Council. The Treasurer shall keep or cause to be kept full and accurate financial records of the Schaghticoke Indian Tribe, to maintain these at a location designated by the Tribal Council and to deposit all funds in a financial institution within reasonable period of time following receipt of monies. At annual meetings of the general membership the Treasurer shall submit, in writing, a financial report and also at regular and annual meetings of the Tribal Council.
V. Authorized Signature
The four officers of the Tribal Council may be authorized to make, sign, endorse and accept on behalf of the Schaghticoke Indian Tribe all promissory notes, drafts, bills exchange and checks, within the circumstances that the Tribal Council may deem appropriate, desirable, necessary or expedient for the affairs of the Schaghticoke Indian Tribe.
